NEON Application Terms of Use

The following terms of use govern all use of the website https://neon.labour.gov.tt/ and all content, services and products available at or through the website (taken together, “the Site”) of by the Ministry of Labour (MOL). The Site is offered subject to your acceptance, without modification, of all the terms of use contained herein and all other operating rules, policies and procedures that may be published from time to time on the Site (taken together, the “Agreement”).

Please read this Agreement carefully before accessing or using the Site. By accessing or using any part of the Site, you agree to become bound by the terms of use in this Agreement. If you do not agree to all the terms of use in this Agreement, then you may not access the Site or use any services.

Use of Site

The Ministry of Labour authorizes you to view and download the materials at this site only for your personal, non-commercial use, provided that you maintain all copyright and other proprietary notices contained in the original materials on any copies of the materials. You may not modify the materials at this site in any way or reproduce or publicly display, perform, or distribute or otherwise use them or any part of them for any public or commercial purpose without the written permission of the Ministry of Labour. For the purposes of this Agreement, any use of these materials or any part thereof on any other website or networked computer environment for any purpose is prohibited. The materials at this site are copyrighted and any unauthorized use of any materials at this site may violate copyright, trademark, and other laws. If you breach any of part of this Agreement, your authorization to use this Site automatically terminates and you must immediately destroy any downloaded or printed material.

Disclaimer and Limitation of Liability

While the Ministry of Labour makes every effort to keep https://neon.labour.gov.tt/ up to date, it does not provide any guarantees, conditions or warranties that the information shall be:

The Ministry of Labour does not publish advice on the site. You should get professional or specialist advice before doing anything on the basis of the content provided on the site.

The Ministry of Labour is not liable for any loss or damage that may come from using the NEON website. This includes:

  • Any direct, indirect or consequential losses.
  • Any loss or damage caused by civil wrongs (‘tort’, including negligence), breach of contract or otherwise.
  • The use of this site and any websites that are linked to or from it.
  • The inability to use this site and any websites that are linked to or from it.

This applies if the loss or damage was foreseeable, arose in the normal course of things or you advised the Ministry of Labour that it might happen. This includes (but is not limited to) the loss of your:

  • Profits or contracts.
  • Opportunity.
  • Anticipated Savings.

General

There may be legal notices elsewhere on the site that relate to how you use it. The Ministry of Labour is not liable for any failure to comply with these terms of use because of circumstances beyond its reasonable control.

The Ministry of Labour might decide not to exercise or enforce any right available to it under these terms of use but can always decide to exercise or enforce that right at a later date. Doing this once shall not mean the Ministry of Labour has automatically waived the right on any other occasion.

If any of these terms of use are held to be invalid, unenforceable or illegal for any reason, the remaining terms of use shall still apply.

The Ministry of Labour may revise the content of this Agreement at any time by updating this posting under our Terms of Use. You should visit this page from time to time to review the current terms because they are binding on all users. You will agree to any changes if you continue to use this site after the terms of use have been updated. Certain provisions of this Agreement may be superseded by expressly designated legal notices or terms located on particular pages at this site.

Website content changes

https://neon.labour.gov.tt/ is made available free of charge.

The Ministry of Labour does not guarantee that this site, or any content on it, will always be available or be uninterrupted. The Ministry of Labour may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. The Ministry of Labour shall try to give you reasonable notice of any suspension or withdrawal.

Keep your account details safe

If you choose or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you shall treat such information as confidential. You shall not disclose it to any third party.

The Ministry of Labour has the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in the Ministry of Labour’s reasonable opinion, you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you know your user identification code or password, you shall promptly notify us via the Chatbot.

User Submissions

Other than personally identifiable information, which is covered under NEON’s Privacy Policy (available on our homepage and at the bottom of every https://neon.labour.gov.tt/ web page), any material, information or other communication a user of the Site transmits or post to this site shall be considered non-confidential and non-proprietary (taken together as “Communications“). The Ministry of Labour has unlimited rights to such Communications and may use it for any purpose within our legal capacity. The Ministry of Labour and its designees shall be free to copy, disclose, distribute, incorporate and otherwise use the Communications and all data, images, sounds, text, and other things embodied therein for any and all commercial or non-commercial purposes. Users are prohibited from posting or transmitting to or from this Site any unlawful, threatening, libellous, defamatory, obscene, pornographic, or other material that would violate any law.

Viruses

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

  • You shall not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.
  • You shall not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site.
  • You shall not attack the Ministry of Labour’s site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act, Chap 11:17. The Ministry of Labour shall report any such breach to the relevant law enforcement authorities and shall co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site shall cease immediately.

Applicable Laws

This Agreement shall be governed in all respects by the substantive Laws of the Republic of Trinidad and Tobago. Any controversy, claim, or dispute arising out of or relating to the Agreement shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Trinidad and Tobago.
